1. Booking Procedure and Formation of a Contract
1.1. Bookings can be made online, via telephone, or in person.
1.2. A booking request constitutes an offer by you to purchase a travel arrangement.
1.3. A contract is formed when we issue a booking confirmation and invoice, subject to availability.
1.4. We reserve the right to decline any booking at our discretion.

2. Authority to Book for Others
2.1. The person making the booking warrants that they have the authority to accept and do accept these terms and conditions on behalf of all persons named on the booking.
2.2. The lead passenger is responsible for disseminating all relevant information to all members of the party.

3. Payment Details
3.1. Deposit: A partial deposit is required at the time of booking. This deposit is refundable up to 48 hours before the scheduled start of the booking. After this 48-hour window, any refund of the deposit is at the sole discretion of Madadays Ltd.
3.2. Balance Payment: The remaining balance of the tour cost can be paid in one of the following ways:
– In full the day prior to the tour’s departure.
– On the morning of the tour itself.
– If multiple tours are booked, the balance can be paid in several installments, as agreed upon with Madadays Ltd prior to the first tour.
3.3. Surcharges: Prices are subject to change due to fluctuations in currency exchange rates, fuel costs, taxes, and modifications requested by you to our itineraries. We reserve the right to apply surcharges as permitted by law.
3.4. Refunds: Refunds are subject to our cancellation policy (see section 4).
3.5. Payment Type: We accept credit card, debit card, bank transfer and cash payment.

4. Changes and Cancellation
4.1. Changes by You:
– Requests for changes to bookings are subject to availability and may incur administrative fees.
– Changes made within 1 day of departure may be treated as cancellations.
4.2. Cancellation by You:
– Cancellations must be made in writing.
– Cancellation charges will apply as follows:
– More than 48 hours from the tour start time: Full refund.
– Less than 48 hours from the tour start date: Loss of deposit. A full refund is made for any amounts paid on top of the deposit.
4.3. Changes by Us:
– We reserve the right to make changes to itineraries, accommodations, or other aspects of the holiday.
– If a significant change is necessary, we will inform you as soon as possible and offer the option of accepting the change, accepting a substitute arrangement of equivalent or higher value (if available), or cancelling with a full refund.
4.4. Cancellation by Us:
– We may cancel a booking due to circumstances beyond our control (force majeure), such as natural disasters, political instability, or insufficient bookings.
– In such cases, we will offer a full refund or an alternative tour of comparable value.

5. Payment Protection and Dispute Resolution
5.1. We process payments securely through Stripe, a leading payment gateway.
5.2. Stripe employs advanced security measures, including encryption and fraud detection, to protect your payment information.
5.3. In the event of a dispute regarding a payment processed through Stripe, we will adhere to Stripe’s dispute resolution process.
5.4. Please note that Stripe’s services primarily focus on secure payment processing and dispute resolution, and do not provide financial protection against our insolvency.
5.5. We do not offer package holidays. Therefore, we do not provide financial protection for your booking in the event of our insolvency. 5.6. As we do not provide package holidays, the Package Travel and Linked Travel Arrangements Regulations 2018 do not apply.

6. Tour or Holiday Information and What is Not Included
6.1. We will provide detailed information about the holiday, including the itinerary, accommodation, and included services.
6.2. The following are typically not included:
– Personal expenses.
– Optional excursion stops.
– Meals not specified in the itinerary.
– Travel insurance.
– Visa fees.
– Excess baggage charges.

7. Changes to the Itinerary
7.1. We reserve the right to alter the itinerary due to unforeseen circumstances.
7.2. We will make reasonable efforts to provide comparable alternatives.
7.3. We are not liable for changes caused by force majeure.

8. Accessibility
8.1. Tour Suitability: Due to the nature of the tours and activities we offer, some tours may not be suitable for individuals with accessibility needs.
8.2. Customer Disclosure: It is the customer’s responsibility to disclose any accessibility requirements or limitations at the time of booking or as soon as possible thereafter. This includes, but is not limited to, mobility impairments, visual or hearing impairments, or other medical conditions that may affect participation.
8.3. Tour Assessment: We will make reasonable efforts to assess the suitability of tours based on the information provided by the customer. However, due to the diverse nature of the tours and locations, we cannot guarantee that all tours will be accessible.
8.4. Tour Adjustment or Cancellation: If, upon assessment or during the tour itself, it is determined that the tour is not accessible or that the customer’s participation poses a safety risk, we reserve the right to adjust the tour itinerary or, if necessary, cancel the customer’s participation.
8.5. No Liability: We cannot accept responsibility for any costs, losses, or inconvenience incurred by the customer if a tour cannot proceed or needs to be adjusted due to undisclosed accessibility needs or if the tour is deemed unsuitable for the customer’s condition.
8.6. Communication: Customers are encouraged to contact us with any specific accessibility inquiries prior to booking to discuss their individual requirements.

9. Insurance and Liability for Activities
9.1. It is your responsibility to obtain adequate travel insurance covering medical expenses, cancellation, and baggage loss.
9.2. We are a travel agency and facilitate the booking of tours and activities. These are conducted by independent freelance guides and service providers on the ground. We do not carry out the tours ourselves.
9.3. We act as an intermediary and are not directly responsible for the conduct or safety of these activities.
9.4. You acknowledge and accept that participation in any tour or activity arranged through us is at your own risk.
9.5. We are not liable for any injuries, accidents, illnesses, or death resulting from the activities undertaken during your tour.
9.6. You understand and accept that you are not insured by us for any risks associated with these activities and that the freelance guides may not hold their own insurance.
9.7. We strongly advise that your travel insurance specifically covers participation in the activities you plan to undertake.
9.8. You are responsible for assessing the suitability of each activity and ensuring your own safety.

10. Passport, Visa, and Health Requirements
10.1. You are responsible for ensuring that you have valid passports, visas, and comply with all health requirements for your destination.
10.2. We recommend checking the latest travel advisories from your government.

11. Travel Insurance
11.1. Travel insurance is mandatory for all travellers. We strongly advise that this insurance covers cancellation, medical expenses, personal liability and loss of baggage and personal effects.

12. Baggage Restrictions
12.1. Customers are permitted to bring small personal bags on tours and activities.
12.2. If customers require the transportation of suitcases or larger items, this must be communicated to Madadays Ltd at the time of booking or at least 2 days prior to the tour, to allow for appropriate arrangements.
12.3. We are not responsible for loss or damage to baggage during transit, regardless of size.

13. Limitation of Liability
3.1. Our liability as a travel agency is limited to the price paid for the booking services we provide.
13.2. We are not liable for consequential loss or damage.
13.3. Specifically, we are not responsible for any issues, injuries, accidents, illnesses, or death resulting from the activities and tours themselves. These activities are conducted by independent freelance guides and service providers on the ground, who are responsible for their own operations and liabilities.
13.4. International Conventions: Our liability may be further limited by international conventions such as the Warsaw Convention (for air travel) and the Athens Convention (for sea travel).
13.5. We are not liable for events of force majeure.

14. Local Standards
14.1. Local standards, infrastructure, and conditions may vary from those in your home country.

15. Client Behaviour
15.1. We reserve the right to terminate the holiday of any client whose behaviour is disruptive or offensive.
15.2. No refunds will be given in such cases.
15.3. Clients are responsible for any damages they cause.

16. Complaints Procedure
16.1. Complaints must be made in writing to info@madaday.com within 7 days after your tour.
16.2. We will investigate all complaints and respond within a reasonable timeframe.

17. Compliance with Data Protection Law
17.1. Commitment to Privacy: Madadays Ltd is committed to protecting your personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and [mention any other relevant local data protection laws].

– Our freelance guides and service providers who are essential for delivering the tours and activities you have booked.
– Third-party payment processors (e.g., Stripe) to facilitate secure payments.

18.1. Accuracy of Information: We make every effort to ensure the accuracy of information provided, but we are not responsible for errors or omissions.
18.2. Force Majeure: We are not liable for events beyond our control, including but not limited to natural disasters, war, terrorism, and strikes.
18.3. Severability: If any provision of these terms and conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.1
18.4. Governing Law: These terms and conditions are governed by the laws of the United Kingdom.
18.5. Jurisdiction: Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Edinburgh, Scotland, United Kingdom.
